How Do I Know I Have A Personal Injury Claim?

Is There A Time Limit To File My Personal Injury Claim?

Personal injury claims against private parties and entities generally must be filed within 2 years from the date of the accident. Additionally, any claims of property damage must be filed within 3 years from the date of loss.

For cases against public or governmental entities, there are stricter guidelines. In such cases, a claim generally has to be brought within 6 months of the date of the accident. The public entity then has 45 days to respond in writing. If such an entity denies a claim in writing, you have another 6 months to file a lawsuit. If the public entity does not respond within the 45 days, you then have 2 years from the accident to file suit.

If I Don’t Have Insurance And Get In A Car Accident, Can I File a Claim?
